These General Terms and Conditions of Sale, hereinafter referred to as the “GTC,” govern the sale of products on the website www.wernermazurier.com, hereinafter referred to as the “Site,” by:

Hereinafter referred to as the “Seller” or “Werner Mazurier.”
These Terms and Conditions apply to orders placed on the Website:
- by any individual acting for purposes that fall outside the scope of his or her commercial, industrial, craft, professional, or agricultural activities, hereinafter referred to as the “Consumer Customer”;
- by any individual or legal entity acting in the course of its professional activities, hereinafter referred to as the “Professional Customer.”
The Consumer Customer and the Business Customer are hereinafter referred to individually or collectively as the “Customer.”
Certain provisions of these Terms and Conditions are expressly reserved for Consumer Customers or Business Customers.
The Customer’s status is determined based on the actual purpose of the order. The selection of an account type on the Site shall not have the effect of modifying the mandatory legal provisions.
These Terms and Conditions of Sale take precedence over any other conflicting document issued by the Customer, unless otherwise specified in special terms and conditions, a quote, or a contract expressly accepted in writing by Werner Mazurier.
For Business Customers who benefit from specific commercial terms, the special terms agreed upon with Werner Mazurier shall take precedence over these Terms and Conditions in the event of any conflict.
2. Products and Technical Specifications
2.1 Product Overview
Werner Mazurier markets, among other things, raw materials, products, supplies, machinery, and equipment for the ceramics, porcelain, glass, crystal, and glass art industries.
The key features of the Products are listed on their respective product pages on the Website.
The Customer is required to review this information before placing any order.
The photographs, illustrations, color renderings, and depictions appearing on the Site are intended to present the Products. They cannot guarantee that the Product delivered will be an exact replica, particularly due to differences in screen display, materials, manufacturing processes, and production batches.
However, these differences shall not affect the essential characteristics of the Product or the legal rights of the Consumer Customer.
2.2 Technical Products – Changes in Income
Due to the nature of certain Products sold by Werner Mazurier—including pigments, enamels, paints, glazes, precious metals, preparations, raw materials, and products intended to be fired or processed—the final result may depend on numerous factors unrelated to the Product itself.
Factors that may have an impact include:
- the nature and preparation of the substrate;
- the application method;
- the deposited thickness;
- any mixtures with other products;
- drying conditions;
- the type of oven used;
- temperature and cooking cycle;
- the cooking environment;
- storage conditions;
- the Customer’s manufacturing processes.
Colors, shades, surface effects, viscosities, and post-firing finishes may also vary within reasonable limits from one batch to another, particularly when these variations result from mineral raw materials or industrial processes that are subject to natural variations.
2.3 Technical Information and Safety
The Customer agrees to review and comply with the instructions, technical data sheets, labeling, recommendations for use, and, where available, the safety data sheets for the Products.
Certain Products may be subject to specific restrictions regarding marketing, transportation, storage, handling, or use.
Werner Mazurier reserves the right to restrict or refuse the sale of certain Products when justified by applicable regulations, their classification, or their normal conditions of use.
2.4 Provisions Specific to Professional Clients
The Professional Customer is responsible for verifying that the Product is suitable for the industrial, artisanal, or technical use for which it is intended.
Unless Werner Mazurier has expressly committed in writing to a specific result, the technical advice, recommendations, samples, tests, or information provided by Werner Mazurier are intended to assist the Customer in making a decision and do not exempt the Professional Customer from conducting its own preliminary tests under actual production conditions.
In particular, it is the responsibility of the Professional Customer to verify, prior to any mass production or industrial manufacturing, that the Product is compatible with its substrates, equipment, processes, and baking or manufacturing conditions.
3. Price
3.1 Prices Applicable to Consumer Customers
The prices offered to consumer customers are listed in euros, including all taxes (TTC), unless otherwise specified.
Shipping costs, costs for special packaging, or any other additional charges are disclosed to the Customer before the order is finalized.
3.2 Prices Applicable to Professional Clients
Prices offered to Business Customers are listed in euros, excluding tax (HT), unless otherwise specified.
VAT and any shipping, packaging, or additional service charges are billed separately at the applicable rate.
Any special pricing terms granted to a Professional Customer may depend on the customer’s account, purchase volumes, or commercial agreements entered into with Werner Mazurier.
3.3 Price Changes
Werner Mazurier may change his rates at any time.
The applicable price is the price displayed or expressly communicated to the Customer at the time of final order confirmation, unless there is a clear error.
3.4 Products Whose Price Depends on a Market Rate
Certain Products, particularly certain preparations containing gold, platinum, or other precious metals, may have a price that is directly or indirectly linked to market price fluctuations beyond Werner Mazurier’s control.
The prices of these Products are subject to change until the order is finally confirmed.
The price actually accepted by the Customer upon confirmation of the order constitutes the contractual price, unless specific terms have been expressly agreed upon with a Business Customer.
3.5 International Shipments
For shipments made outside the applicable customs or tax territory, customs duties, import taxes, administrative fees, or other charges may be due.
Unless otherwise specified at the time of the order, these amounts are not included in the price invoiced by Werner Mazurier and are the responsibility of the Client.
4. Customer Account
4.1 Account Creation and Customer Eligibility
To place an order, you must first create a customer account.
When creating an account, the Customer must expressly indicate whether he or she is acting as a Consumer Customer or a Business Customer.
This statement sets forth the provisions of these Terms and Conditions applicable to the Customer’s order. However, in accordance with Article 1, it shall not alter the Customer’s actual status with respect to the actual purpose of their orders, nor shall it alter the applicable mandatory legal provisions.
4.2 Information Specific to Professional Clients
When the Customer identifies as a Business Customer, providing a valid SIRET number is required to create or validate the account, as well as, if applicable, the company name and intra-Community VAT number.
The SIRET number provided is subject to a format check (14-digit structure and check digit) prior to account validation. Werner Mazurier may also conduct any additional verification, particularly by consulting official databases such as the Sirene registry, to ensure that the reported business exists and is active.
Werner Mazurier may refuse or suspend the creation or validation of a business account if the information provided is clearly incorrect, incomplete, or invalid, particularly if the SIRET number is invalid or cannot be found.
4.3 Common Provisions
The Customer agrees to provide accurate, complete, and up-to-date information, and to update it promptly in the event of any change in their circumstances, including their status as a Consumer Customer or a Business Customer.
Login credentials are personal and confidential. The Customer is responsible for safeguarding them and must notify Werner Mazurier as soon as possible of any unauthorized use of their account.
5. Order
5.1 Ordering Process
The Customer selects the Products they wish to order and adds them to their shopping cart.
Before confirming, a summary allows the user to verify, among other things:
- the selected products;
- quantities;
- prices;
- any discounts;
- shipping costs;
- the billing address;
- the shipping address;
- the total amount of the order.
The Customer has the option to correct their order before it is finalized.
The Customer must read these Terms and Conditions and expressly accept them by checking the box provided for that purpose.
For Consumer Customers, the button used to finalize the order clearly indicates that confirming the order results in an obligation to pay, in accordance with applicable regulations.
5.2 Formation of the Contract
The order is not finalized until:
- confirmation of the order by the Customer;
- acceptance of these Terms and Conditions;
- validation of the payment method or, for Business Customers eligible for deferred payment terms, acceptance of the order by Werner Mazurier;
- Werner Mazurier sent an order confirmation.
The confirmation is sent by email to the address provided by the Customer.
5.3 Refusal or Cancellation of an Order
Werner Mazurier may refuse or cancel an order for a valid reason, including:
- any payment issue or delay related to a previous order;
- reasonable suspicion of fraud;
- information that is clearly incorrect;
- an order that appears to be unusual;
- Product unavailability;
- a legal or regulatory prohibition on selling or transporting the Product to the requested destination;
- Exceeding an authorized open position limit for a Professional Client.
Werner Mazurier will notify the Client as soon as possible.
6. Product Availability
Offers are valid while supplies last or subject to availability.
The availability information displayed on the Site is updated as frequently as possible but does not constitute an absolute guarantee of availability until the order is confirmed.
Consumer Customers
If a Product is unavailable after an order has been placed, Werner Mazurier will notify the consumer customer as soon as possible.
Werner Mazurier may offer a replacement product, but it will be substituted for the ordered Product only with the Customer’s express consent.
In the absence of an agreement, the amounts corresponding to the Unavailable Product will be refunded in accordance with applicable regulations.
Business Customers
Unless otherwise agreed, Werner Mazurier may make partial deliveries or carry over the remaining portion of an order.
The Professional Client has been informed of this.
7. Payment
7.1 Payment Methods
The accepted payment methods are those listed on the Website at the time of the order, including:
- credit card;
- Bank transfer;
- Check.
Online credit card payments are processed using the secure Stancer solution, a brand operated by Iliad 78, a payment institution authorized by the ACPR.
Werner Mazurier does not retain the Customer’s complete banking information when it is processed directly by the payment service provider.
7.2 Consumer Customers
Unless otherwise specified, the price is payable in full at the time of order.
The order may be suspended or canceled if payment authorization is denied or the transaction fails.
7.3 Business Customers
Unless specific terms have been expressly agreed upon by Werner Mazurier, orders from Business Customers are payable in full upon delivery.
Werner Mazurier may grant certain Business Customers specific payment terms or conditions, as specified in the quote, order confirmation, or invoice.
In the event of a late payment, the amounts due shall automatically accrue interest, as of the day following the due date and without the need for a reminder, at a rate equal to the interest rate applied by the European Central Bank to its most recent refinancing operation, plus 10 percentage points, subject to the applicable statutory minimum.
Any Business Customer who is in arrears is also automatically liable to pay a flat-rate indemnity of 40 euros per unpaid invoice to cover collection costs.
If the actual collection costs incurred exceed this lump-sum compensation, Werner Mazurier may request additional compensation upon providing supporting documentation.
Unless otherwise expressly agreed, no discount is granted for early payment.
In the event of a late payment, Werner Mazurier may also suspend pending orders or deliveries, refuse new orders, or revise the payment terms granted to the Business Customer, without prejudice to its other rights.
8. Delivery
8.1 General Information
The Products are delivered to the address provided by the Customer when placing the order.
It is the Customer’s responsibility to verify that this address is accurate and accessible.
Delivery areas, shipping methods, rates, and estimated delivery times are listed on the Website or provided to the Customer before the order is placed.
8.2 Consumer Customers
Werner Mazurier delivers the Products on the date or within the timeframe specified at the time of the order.
If no delivery time is specified, delivery shall be made without undue delay and no later than the time limit set forth in the applicable regulations.
In the event of a delay in delivery, the Consumer Customer is entitled to the rights provided for, in particular, in Articles L.216-1 et seq. of the Consumer Code.
8.3 Business Customers
Unless Werner Mazurier has provided a written commitment expressly specifying a firm and binding delivery date, the delivery times communicated to Business Customers are provided for informational purposes only.
A reasonable delay, on its own, cannot justify the cancellation of the order or give rise to compensation, unless otherwise required by law or specified in a written agreement.
Partial deliveries are permitted unless otherwise agreed.
8.4 Heavy, bulky, or pallet-shipped items
Specific delivery terms for ovens, equipment, pallets, or other heavy or bulky Products are specified in the Product sheet, in the quote, or at the time of ordering.
Unless otherwise expressly provided, standard delivery does not include installation, commissioning, or handling within the Customer’s premises.
The Customer must ensure that the delivery locations are accessible to the vehicles and equipment needed for transportation.
Any special handling, installation, or setup service must be agreed upon in advance.
8.5 Failure to Deliver or Impossibility of Delivery
If delivery cannot be made due to incorrect information provided by the Customer, the Customer’s absence, or an inability to access the premises that was not reported to Werner Mazurier, reasonable costs for a return visit or reshipment may be billed to the Customer within the limits permitted by applicable regulations.
9. Receiving – Damage – Claims
9.1 Consumer Customers
The Consumer Customer is asked to check the apparent condition of the package and the Products upon receipt.
In the event of visible damage, it is recommended that you file a detailed claim with the carrier and promptly notify Werner Mazurier to facilitate the processing of the case.
The absence of any objections upon delivery does not deprive the Consumer Customer of the rights granted to him or her under the applicable statutory warranties.
9.2 Business Customers
The Business Customer must inspect the condition, quantity, and product codes of the Products upon receipt.
Any loss, damage, or deterioration attributable to transportation must be the subject of specific reservations filed with the carrier and, when necessary to preserve the right to seek recourse against the carrier, a formal complaint must be filed in the manner and within the time limits provided for in Article L.133-3 of the Commercial Code.
The Professional Client must notify Werner Mazurier as soon as possible and provide him with the supporting documents necessary to process the case.
These provisions do not preclude a claim regarding a defect that was not apparent at the time of delivery.
10. Retention of Title and Transfer of Risk
10.1 Retention of Title
Werner Mazurier retains ownership of the Products sold until full payment of the price, including principal and ancillary charges, has been made.
Failure to pay may result in the Products being reclaimed in accordance with the terms set forth in applicable regulations.
10.2 Consumer Customers
The risk of loss or damage to the Products passes to the Consumer Customer when the Customer physically takes possession of the Products, or when a third party designated by the Customer takes possession of them, in accordance with applicable legal provisions.
When the Consumer Customer arranges for delivery through a carrier of their own choosing—one not recommended by Werner Mazurier—the specific legal rules governing the transfer of risk apply.
10.3 Business Customers
Unless otherwise agreed or an Incoterm is expressly agreed upon, risk passes to the Business Customer upon delivery of the Products to the carrier or upon their availability for pickup by the Customer.
The retention of title provided for above does not preclude the transfer of risk.
SPECIFIC PROVISIONS FOR CONSUMER CUSTOMERS
11. Right of Withdrawal
11.1 Principle
In accordance with Articles L.221-18 et seq. of the Consumer Code, the Consumer Customer has, barring any legal exceptions, a period of fourteen (14) days to exercise their right of withdrawal without having to provide a reason for their decision.
For the sale of a Product, this period begins upon receipt of the Product by the Customer or by a third party designated by the Customer other than the carrier.
If an order consists of multiple Products that are delivered separately, the period begins upon receipt of the last Product, provided that the relevant legal conditions are met.
11.2 Terms and Conditions for Exercise
The Customer may exercise his or her right:
- using the cancellation form attached to these Terms and Conditions;
- by any unambiguous written statement expressing the consumer’s intention to withdraw;
- using the “Exercise My Right of Withdrawal” feature, which is directly accessible on the Website. When the withdrawal is made online, Werner Mazurier shall promptly send the Customer an acknowledgment of receipt of the withdrawal in a durable medium.
The online feature is accessible and identifiable in accordance with applicable regulations.
When the cancellation is made online, Werner Mazurier sends the Customer a confirmation of receipt in a durable medium.
11.3 Product Returns
After exercising their right of withdrawal, the Customer must return the Products without undue delay and no later than fourteen (14) days after notifying the Company of their decision.

Unless otherwise specified, the Customer is responsible for the direct return shipping costs.
For Products that, due to their nature, weight, or volume, cannot normally be returned by mail, the estimated cost of the return is provided to the Customer before the order is finalized, in accordance with applicable regulations.
11.4 Condition of Returned Products
In accordance with Article L.221-28 of the Consumer Code, sealed products (pigments, precious metals, auxiliary products) that have been unsealed by the Customer after delivery—and whose integrity cannot be guaranteed for health and safety reasons once the seal has been broken—cannot be returned or exchanged under the right of withdrawal.
The Customer may handle the Product to the extent necessary to determine its nature, characteristics, and proper functioning.
He or she may be held liable in the event of damage resulting from handling that goes beyond what is necessary for this inspection.
11.5 Refund
In the event of a valid cancellation, Werner Mazurier will refund the amounts paid, including the initial shipping costs corresponding to the standard shipping method offered, in accordance with the terms and timeframes set forth in Article L.221-24 of the Consumer Code.
Any additional charges resulting from the Customer’s choice of a delivery method that is more expensive than the standard method offered will not be refunded.
Werner Mazurier may delay the refund until the Products are returned or until proof of their shipment by the Customer is received, in accordance with applicable legal provisions.
Refunds are processed using the same payment method used for the original transaction, unless the Customer expressly agrees to use another method that does not incur any fees.
11.6 Exceptions to the Right of Withdrawal
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal may not be exercised—even when the legal conditions are met—in the following cases:
- goods manufactured to the Customer’s specifications or significantly customized;
- Products whose price depends on fluctuations in the financial market beyond Werner Mazurier’s control and that may occur during the withdrawal period;
- goods that, after delivery and by their very nature, are inseparably mixed with other items;
- other categories of goods or services expressly excluded by Article L.221-28 of the Consumer Code.
The exception regarding market fluctuations may apply, in particular, to certain Products containing gold, platinum, or other precious metals when their price actually meets the conditions set forth by law.
If a Product is not covered by the right of withdrawal, the Customer is notified of this fact before the order is confirmed.
The statutory right of withdrawal described in this article does not apply to Business Customers, unless Werner Mazurier has expressly agreed otherwise.
12. Statutory Warranties Applicable to Consumer Customers
Products sold by Werner Mazurier to consumer customers are covered by the applicable statutory warranties, regardless of any commercial warranty or manufacturer’s warranty.
12.1 Statutory Warranty of Conformity
Werner Mazurier is responsible for the statutory warranty of conformity under the terms set forth in Articles L.217-3 et seq. of the Consumer Code.
In particular, subject to applicable law, the Customer is entitled to have the Product brought into compliance through repair or replacement and, when the conditions are met, to a price reduction or termination of the contract.
STATUTORY WARRANTY OF CONFORMITY
The consumer has two years from the date of delivery of the goods to enforce the statutory warranty of conformity in the event that a lack of conformity arises. During this period, the consumer is only required to establish the existence of the lack of conformity, not the date on which it first appeared.
When the contract for the sale of the good provides for the continuous supply of digital content or a digital service for a period exceeding two years, the statutory warranty applies to such digital content or digital service throughout the entire period of supply. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service, and not the date on which it first appeared.
The statutory warranty of conformity requires the seller, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The statutory warranty of conformity entitles the consumer to have the item repaired or replaced within thirty days of making the request, at no cost and without significant inconvenience to the consumer.
If the product is repaired under the statutory warranty of conformity, the consumer is entitled to a six-month extension of the original warranty.
If the consumer requests that the item be repaired, but the seller insists on replacing it, the statutory warranty of conformity is renewed for a period of two years from the date the item is replaced.
The consumer may obtain a reduction in the purchase price while retaining the goods, or terminate the contract and receive a full refund upon returning the goods, if:
- The service provider refuses to repair or replace the item;
- The repair or replacement of the item takes place after a period of thirty days;
- The repair or replacement of the product causes significant inconvenience to the consumer, particularly when the consumer is permanently responsible for the costs of returning or picking up the nonconforming product, or if the consumer is responsible for the costs of installing the repaired or replacement product;
- The property remains noncompliant despite the seller’s unsuccessful attempt to bring it into compliance.
The consumer is also entitled to a price reduction or termination of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In such cases, the consumer is not required to first request repair or replacement of the item.
The consumer is not entitled to rescind the sale if the lack of conformity is minor.
Any period during which the item is out of service for repair or replacement suspends the remaining warranty period until the repaired or replaced item is delivered.
The rights mentioned above arise from the application of Articles L. 217-1 through L. 217-32 of the Consumer Code.
A seller who, in bad faith, obstructs the enforcement of the statutory warranty of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10 percent of the seller’s average annual revenue (Article L. 241-5 of the Consumer Code).
The consumer is also covered by the statutory warranty against hidden defects under Articles 1641 through 1649 of the Civil Code, for a period of two years from the date the defect is discovered. This warranty entitles the consumer to a price reduction if the item is retained, or to a full refund upon return of the item.

12.2 Warranty Against Hidden Defects
The Customer is also covered by the statutory warranty against hidden defects provided for in Articles 1641 et seq. of the Civil Code.
When the legal conditions are met, the Customer may, in particular, choose between rescinding the sale or obtaining a price reduction in accordance with the provisions of the Civil Code.
12.3 Commercial or Manufacturer’s Warranties
Certain materials or equipment may be covered by a commercial warranty or a warranty provided by their manufacturer.
The specific terms and conditions of this warranty are set forth in the product sheet, the accompanying documentation, or the manufacturer’s warranty terms.
Any commercial warranty applies without prejudice to the statutory warranties to which the Consumer Customer is entitled.
SPECIFIC PROVISIONS FOR PROFESSIONAL CLIENTS
13. Professional Use – Inspection and Testing
The Business Customer acknowledges that it possesses the necessary skills to use the Products it orders, or agrees to engage individuals with the necessary qualifications.
In particular, it is responsible for:
- to verify the compatibility of the Products with its processes;
- to comply with the storage and usage instructions;
- to comply with the technical data sheets and safety data sheets;
- to conduct the necessary preliminary tests;
- to verify the results before any mass production begins;
- to comply with the regulations applicable to its business and to its use of the Products.
Unless Werner Mazurier has expressly agreed in writing, any advice, recommendation, or test conducted as part of the support services does not constitute a guarantee of results under the Client’s specific production conditions.
No claim may be based on a variation in results attributable solely to manufacturing, application, baking, storage, or processing parameters within the Customer’s control.
14. Warranty Applicable to Professional Customers
Werner Mazurier guarantees that the Products conform to the contractually agreed specifications.
In particular, the warranty does not cover damage or defects resulting from:
- inappropriate storage;
- due to improper handling;
- use that is inconsistent with the technical documentation;
- resulting from a mixture, processing, or modification performed by the Customer;
- contamination of the Product after opening;
- use on an incompatible substrate or in an incompatible process;
- normal wear and tear;
- a lack of maintenance;
- use for which the Product was not designed.
For hardware and equipment from third-party manufacturers, the manufacturer’s warranty terms may apply under the conditions specified at the time of sale.
These provisions do not preclude any warranties or liabilities that cannot be legally excluded or limited.
15. Liability
15.1 Consumer Customers
These Terms and Conditions do not limit any rights or liabilities that may not be excluded or limited under any mandatory legal provision applicable to the Consumer Customer.
15.2 Business Customers
Werner Mazurier shall be liable only for direct and foreseeable damages resulting from a breach attributable to him.
Unless otherwise required by law, Werner Mazurier shall not be liable for any indirect or consequential damages suffered by a Business Client, including:
- loss of production;
- operating loss;
- loss of revenue or margin;
- loss of business or customers;
- data loss;
- damage to reputation;
- cost of shutting down a production line;
- the cost of recalling or withdrawing a product when Werner Mazurier has not expressly guaranteed in writing the result that caused the damage.
Except in cases where a limitation of liability is prohibited by law, Werner Mazurier’s total liability arising from an order placed by a Business Customer is limited to the amount (excluding tax) actually paid for the order or the Product that directly caused the damage.
In particular, this limitation does not apply in the event of fraudulent or grossly negligent conduct on the part of Werner Mazurier, bodily injury, or in any other case where liability cannot be legally limited.
16. Force Majeure
Neither Party shall be held liable for any delay or failure to perform resulting from an event constituting a force majeure event as defined in Article 1218 of the Civil Code and under French case law.
If the impediment is temporary, performance of the obligation in question is suspended for the duration of the impediment, unless the delay justifies termination of the contract.
If the impediment is permanent, the contract may be terminated under the conditions provided by law.
The Parties shall notify each other as soon as possible of any event that may significantly affect the performance of their obligations.
17. Intellectual Property
The Website and all of its components, including but not limited to text, photographs, videos, illustrations, trademarks, logos, graphics, databases, site maps, and technical elements, are protected by applicable intellectual property rights.
Unless prior written authorization is obtained from Werner Mazurier or the holder of the relevant rights, any reproduction, display, adaptation, extraction, or use of all or part of the Site for purposes other than strictly personal ones is prohibited.
Technical data sheets, documentation, and materials provided by manufacturers remain subject to the rights of their respective owners.

Personal data collected when creating an account, browsing the Site, or placing an order is processed in accordance with applicable data protection regulations.

19. Evidence—Confirmation and Retention of the Contract
The data stored in the computer systems of Werner Mazurier and its service providers constitutes evidence of the orders and transactions carried out, subject to any contrary evidence that may be presented in accordance with applicable law.
The order confirmation is sent to the Customer electronically.
For contracts entered into remotely with a consumer customer, Werner Mazurier provides the required contractual information on a durable medium in accordance with applicable regulations.
When the provisions regarding the retention of contracts entered into electronically apply, Werner Mazurier retains the contract for the required period and ensures that the Customer has access to it upon request.

21. Consumer Mediation

22. Governing Law and Jurisdiction
These Terms and Conditions and the contracts entered into on the Site are governed by French law, subject to any mandatory provisions that may apply to Consumer Customers residing in another country.
Consumer Customers
In the event of a dispute that cannot be resolved amicably or through mediation, the competent courts shall be determined in accordance with applicable laws.
No provision of these Terms and Conditions of Sale shall deprive the Consumer Customer of the mandatory rules governing jurisdiction to which he or she is entitled.
Business Customers
The Parties shall endeavor to seek an amicable resolution before initiating any legal proceedings.
BETWEEN PARTIES WHO HAVE ALL ENTERED INTO THIS AGREEMENT AS MERCHANTS, ANY DISPUTE RELATING TO THE FORMATION, VALIDITY, INTERPRETATION, PERFORMANCE, OR TERMINATION OF THE CONTRACT SHALL FALL WITHIN THE EXCLUSIVE JURISDICTION OF THE COMMERCIAL COURT OF LIMOGES, INCLUDING IN CASES INVOLVING MULTIPLE DEFENDANTS OR THIRD-PARTY PROCEEDINGS, SUBJECT TO ANY CONTRARY MANDATORY STATUTORY PROVISIONS.
For Business Customers who are not acting in their capacity as merchants, the statutory rules on jurisdiction apply.
23. Changes to the Terms and Conditions
Werner Mazurier may modify these Terms and Conditions at any time.
The version applicable to an order is the one accepted by the Customer at the time the order is placed.
Subsequent changes to the Terms and Conditions do not affect orders that have already been placed.
24. Severability of Provisions
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
The fact that Werner Mazurier does not invoke any provision of these Terms and Conditions at a given time does not constitute a waiver of the right to invoke it at a later time.

APPENDIX 2 – STATUTORY WARRANTY OF CONFORMITY
Regulatory box reproduced in accordance with the model set forth in the appendix to Article D.211-2 of the Consumer Code.
STATUTORY WARRANTY OF CONFORMITY
The consumer has two years from the date of delivery of the goods to enforce the statutory warranty of conformity in the event that a lack of conformity arises. During this period, the consumer is only required to establish the existence of the lack of conformity, not the date on which it first appeared.
When the contract for the sale of the good provides for the continuous supply of digital content or a digital service for a period exceeding two years, the statutory warranty applies to such digital content or digital service throughout the entire period of supply specified in the contract. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service, and not the date on which it first appeared.
The statutory warranty of conformity requires the seller, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The statutory warranty of conformity entitles the consumer to have the item repaired or replaced within thirty days of making the request, at no cost and without significant inconvenience to the consumer.
If the product is repaired under the statutory warranty of conformity, the consumer is entitled to a six-month extension of the original warranty.
If the consumer requests that the item be repaired, but the seller insists on replacing it, the statutory warranty of conformity is renewed for a period of two years from the date the item is replaced.
The consumer may obtain a reduction in the purchase price while retaining the goods, or terminate the contract and receive a full refund upon return of the goods, if:
- The service provider refuses to repair or replace the item;
- The repair or replacement of the item takes place after a period of thirty days;
- The repair or replacement of the product causes significant inconvenience to the consumer, particularly when the consumer is permanently responsible for the costs of returning or picking up the nonconforming product, or if the consumer bears the costs of installing the repaired or replacement product;
- The property remains noncompliant despite the seller’s unsuccessful attempt to bring it into compliance.
The consumer is also entitled to a price reduction or to rescission of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or rescission of the contract. In such cases, the consumer is not required to first request repair or replacement of the goods.
The consumer is not entitled to rescind the sale if the lack of conformity is minor.
Any period during which the item is out of service for repair or replacement suspends the remaining warranty period until the repaired or replaced item is delivered.
The rights mentioned above arise from the application of Articles L. 217-1 through L. 217-32 of the Consumer Code.
A seller who, in bad faith, obstructs the enforcement of the statutory warranty of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10 percent of the average annual revenue (Article L. 241-5 of the Consumer Code).
The consumer is also covered by the statutory warranty against hidden defects pursuant to Articles 1641 through 1649 of the Civil Code, for a period of two years from the date the defect is discovered. This warranty entitles the consumer to a price reduction if the item is retained, or to a full refund upon return of the item.
